School for Scoundrels

Further to my article called ticket to ride. I happened to come across a candidate who belongs to some party called something which I cannot pronounce. (Bahujan / Samajwadi / Swadeshi / something or the other with a couple of other long sounding words thrown in following, Isn’t it funny all how politicians choose names which sound as if they are 100% for the common man when all they are there for is the “moolah”)

Now me being the perverse person I am, I decided to see if that person who was contesting the elections fared any better at knowing WHAT they were STANDING FOR than my friends did when I asked them WHAT they were VOTING FOR.

So I went in to one of the site links the candidate is using to push his candidature and checked the answers they had given there to questions put to them.

I was amazed at what I read. The candidate had made promises across the world about subjects over which they would have no control even if he was elected in THIS ELECTION.

I saw promises like “I will remove octroi” and a lot more like that. What’s more the whole communication wasminister pompous and full of me this me that , I have done this I have done that, and demeaning to the whole system saying everyone else is a thief, corrupt or generally unfit.

In one of their communications to me, that person even went so far as to say that they were far more qualified than Soniaji, Advaniji, Manmohanji and anyone else in todays’ political scene. What amazed me was that in the mails shooting back and forth the general public hailed this candidate as the new messiah even though twice this person had reacted badly to criticism with very very personal nasty mails to any criticism which was directed his way which was in open public domain.

There were messages abounding that this candidates plans and manifesto were so “public minded” and the candidate even forwarded me one such mail as to how popular their plans were and what a moron I was for saying what I was saying.

I wrote to the candidate saying that their manifesto was full of holes since they were commenting on subjects which are under the State list (Octroi is one such subject) and under no way would they be under their purview.

For those who didn’t read my last article carefully ( I dont blame them for not reading it, it was long and technical) --- The Indian Legislature machinery is based upon the Federal system and is divided into two parts. Some items are controlled by the Central Govt and some by state and some jointly.

What is controlled by the Central Govt. i.e. the Parliament is defined under List 1 (the union list) of the Seventh Schedule of the Constitution of India.

What is controlled by the State legislature ( what we are NOT voting for this time) is defined under List 2 (the state list) of the Seventh Schedule of the Constitution of India.

What they both have rights over jointly is defined under List 3 (the concurrent list) of the Seventh Schedule of the Constitution of India.

I therefore wrote to that person and offered to work with them on the manifesto fine tuning so that the general public does not lose hope in their “saviour” IF and when they get elected. What I got back was a caustic reply which is as follows:

Post 26/11 and especially after 3/12 I too thought India’s time had come and shahenshahwe would see a new uprising but from what I’m seeing the new lot also have a lot of people in them who have been watching too many Shahenshah movies and thinking “rishte mein they are everyone bapp”.

So what if they make speeches with the word “change” sprinkled in every 4th word, its still old wine in a new shiny bottle.

Folks, its not that simple. For anything to change, the person being elected must want it to change and then must follow the system to change it. (see box below) The system to make a change is a long and complicated one involving Ministries, Permanent Secretaries, Council of Ministers and Prime Minister along with the President. Unlike Akbar, one person cannot make a sweeping change with a gesture of his hand or a firmann. (opps maybe the person watched too much Bruce Almighty and not Shahenshah as I thought earlier)

We are electing representatives attend the Parliament of India and make laws for our benefit and not wannabe Amitabhs who will enter Parliament and shoot everyone they think corrupt (like he did in one movie), so Munnabhai and his ilk is definitely out.

The person we elect must know what he can and cannot do. They must also know how he can and cannot do it.

I seriously think that this person I corresponded with and many like him are fit for the jago re ad where they need to be asked if they really have any idea of the job they are applying for.

An article in the same vein in Mumbai Mirror front page a couple of days ago shows that more than half the people in power currently don’t know what the parliament does so how can I really blame this person, at least he had the courtesy to fill in his remarks which a lot of other candidates did not.

As to the candidate asking why I am doing back seat driving , unlike them I am not a person who does anything prematurely. I had already written in my articles post 26/11 that knee jerk reactions were good but were not in my frame of reference and any real changes I foresaw would only be in the next elections and not the 2009 one.

Before prematurely jumping off the ramp, I first of all intend to go to school and study the mechanism (I believe TN Seshan has setup a school for politics in Pune, I am looking into it). Once I know how the Indian Legislature works, maybe this pompous candidate may see a new opponent in the next election, one who really understands what needs to be done and how.

I must also say that the elections have brought out the worst in some people, I have been watching the mails shooting back and forward for the candidates from Mumbai South and see that the people who are for and against the PPI and Meena Sayal (independent) are now getting caustic and personal. I know passion is good, fire is good but slanging one another because we are not in agreement about each others politics makes us no different from the current lot.

Both these fine ladies have their own motives for standing and we must commend them for coming forward. Win or lose, they have at least shown Mumbai it can be done. Till they stood up and asked to be counted, everyone just turned up their nose at the word called politics. No one wanted to wade in the muck.

BRAVO , MY Hats off to you two !!!!!!!

Given a chance I would any day prefer giving them a chance rather than giving my vote to a famous politician who blocked the main thoroughfare in Juhu last week so that their “PADYATRA” could pass by. One sight I will never forget is that of a Mercedes following the cavalcade bearing the party flags with two dark oily looking gold chain loaded “Circuit style”( Bappida had competition) mobile phone talking men standing up through the sun roof glaring at all and sundry as the car sped by.

That my friends is the calibre of todays politicians. So before you vote, read the promises your candidate is making CAREFULLY. Can he / she fulfill them? If the answer is no, we will see a 26/11 again, take it for a fact.

Today I saw an article in the Eco Times which talks about the Govt. examining the possibility of Companies paying off their international debts , etc using shares / equity. Now this as I explained takes a lot of in depth study etc before it can be done. The bill allowing this will have to move through the ranks which may take upto 3-4 years,

No one minister or MP can just sauter in and say , voila I have done it. Even if this is done 3 years in the future, the procedure has started now, so who do we credit with this move, the MINISTER who started it, the MP who should raise questions to ascertain that its in the interest of his constituents or the PRIME MINISTER who will table the bill or the PRESIDENT who will sign it ?

Further now that we have elections bang snap in the middle of the flow of this bill, which government gets the credit for it ?

As I said its not an overnight procedure so please do not be taken in by INSTANT GRATIFICATION promises.

Ticket to ride

A lot of my readers have written in asking me why I have not written for a while. Yesterday, one of my friends convinced me to put down my thoughts in writing since it may help some readers understand the mess we are in.

A lot of of people have SMSed me or written Emails or contacted me in some way or the other telling me to vote.

I saw the ad campaigns running on TV and in the press as to how Pappu raj will reign unless I do or how I should “Jago Re”.

Me being the perverse person I am, decided to ask the people who told me to make sure I vote if they knew what exactly was I voting for, how did the Indian Parliamentary system work. Guess what. None of the people I know really understood what they were voting for. Of course they knew who they were voting for but not WHAT they were voting for.

So I decided to make a little synopsis for my readers to really “Jago Re”.

( for those readers who would like a bit of background) First of all, India, a union of states, is a Sovereign, Secular, Democratic Republic with a Parliamentary system of Government. The Indian polity is governed in terms of the Constitution, which was adopted by the Constituent Assembly on 26 November 1949 and came into force on 26 November 1950. The Constitution which envisages parliamentary form of government is federal in structure with unitary features.

indian parliment1The President is the constitutional head of the Union of India.

The Union Executive (The top rung) consists of the President, the Vice-President and Council of Ministers with the Prime Minister at the head to aid and advise the President in his / her duties.

The real executive power (power to do things eg legislate) vests in a Council of Ministers with the Prime Minister as head. 

The Council of Ministers comprises Cabinet Ministers, Minister of States (independent charge or otherwise) and Deputy Ministers. Prime Minister communicates all decisions of the Council of Ministers relating to administration of affairs of the Union and proposals for legislation to the President.

Article 74(1) of the Constitution provides that there shall be a Council of Ministers headed by the Prime Minister to aid and advise the President who shall, in exercise of his functions, act in accordance with such advice.

Now since most Ministers may not know exactly what to do, each bureaucratic department has an officer designated as secretary to the Government of India to advise Ministers on policy matters and general administration.

The Cabinet Secretariat has an important coordinating role in decision making at highest level and operates under direction of Prime Minister.(All those of us who have seen Yes Minister or its Indian version knows how important the permanent secretary is to the Political machinery and how they get things done) 

In short The Council of Ministers is the real power behind the throne and collectively answerable to the Lok Sabha, the House of the People.

The people we are voting for in this election is the Lok Sabha representatives.

Now we must remember that the thrill for your local goon doesn't lie in being a Lok Sabha representative, the fun lies in being a Minister or even a Prime Minister so that he is the one with the “real executive power “. lok sabha

That is why the candidates all horse trade to be in the majority in the Lok Sabha since the Ministers are picked from the party which wins a majority of the seats in the Lok Sabha and they  all want to be the movers and shakers. Thats where the real moolah lies

Now this election day, when you go and vote for your local Papu who has stood in the way of bulldozers when they came to demolish the slums in your area, remember he will first of all become a representative of the Lok Sabha.

In the Lok Sabha it is his responsibility to hold the Council of Ministers accountable for their actions and ergo he must be able to logically and systematically understand what he has to question and what not. Before putting the cross next to his name, ask yourself, is he capable of doing that ?

Ask yourself is he capable of reading a report on how the funds for educating all the girls across India below 11years will be arranged or is he the kind of person who will shoot his mouth off first and remove the foot from it later.

What is a Lok Sabha Representative, he is the voice of the people. Is the person you are voting for your voice or is he the voice who will dictate to you for the next 5 years ?

Now assuming despite your deliberation, your Papu becomes your Lok Sabha Representative, he a_circuitor his faction of the government will lobby to make him “Minister for XYZ”.

That means that Papu now controls the future of what happens in the country as far as XYZ is concerned. (Things are now getting dangerous).

For example, lets say Papu is in charge of Home affairs. Does he understand the concept of security ? Does he know the difference between Kevlar and Iron plate vests for the Black Cats ? Of course not. For that he needs to depend upon advisors. And who does the average Papu have for an advisor. His local “Circuit”, Mr. Fix it all.

Do you really think a local goon who is used to fixing things on a local level has the expertise to handle your future ?

He had the right mix of technocrats from Sam Pitroda downwards who knew what technology meant. In order to be a good leader , you dont need to know everything, you just have to have the ability to let your team do its work.

Case to point is Lalu Prasad. He has not done anything earth shattering, in fact most of the plans being implemented under his regime were planned tens of years ago, since you cant just plan and slap a bridge or announce a new railway line overnight, there is a lot of research and planning involved.

Lalu’s only positive point is he doesn’t interfere with the people who actually do the job, which is why the railways has gone from a loss  making venture to a profit making one.

Now assuming that he has pulled the ultimate joker and becomes a Prime Minister, now we really are in trouble.

corrupt politician Whatever happens he will be  a part of the legislative machinery, the machinery which decides the fate of future India. The Legislative Arm of the Union, called Parliament, consists of the President, Rajya Sabha and Lok Sabha. All legislation requires consent of both Houses of Parliament. However, in case of money bills, the will of the Lok Sabha always prevails.

Under the Constitution, Parliament has the power to make laws for the whole of or any part of the territory of India. The subjects on which legislation can be enacted are specified in the Seventh Schedule of the Constitution. Parliament has the exclusive right to legislate in respect of items appearing in List I, called the Union List. This list includes areas such as defense, foreign affairs, currency, income tax, excise duty, railways, shipping, posts and telegraphs, etc.

Both Parliament and the State Legislatures have the power to legislate in items appearing in List III of the Constitution which is known as Concurrent List. This list includes items like electricity, newspapers, criminal law, marriage and divorce, stamp duties, trade unions, price controls etc.

This means that Papu once elected has a say in topics such as Defense ,electricity, criminal law,etc. “Criminal law” huh, now wonder every 2 bit goon wants to be in legislature. I can just imagine what would have happened to gun laws if Munnabhai has reached parliament.

Rajya Sabha (Upper House)

The Rajya Sabha consists of 245 members. Of these, 233 represent states and union territories and 12 members are nominated by the President. Elections to the Rajya Sabha are indirect; members are elected by the elected members of Legislative Assemblies of the concerned states. The Rajya Sabha is not subject to dissolution, one third of its members retire every second year.

Lok Sabha (Lower House) <---- This is what we are voting for this time.

The Lok Sabha is composed of representatives of the people chosen by direct election on the basis of universal adult suffrage. As of today, the Lok Sabha consists of 545 members with two members nominated by the President to represent the Anglo-Indian Community. Unless dissolved under unusual circumstances, the term of the Lok Sabha is five years

I hope the system is clear to all of my readers and please do feel free to write in and ask any questions that you may have, but do remember that till recently I too was the kind of person who voted either for the person at the centre (the figurehead of the party) Manmohan Singh or LK Advani or maybe for the local popular or famous figure head like maybe Govinda or Priya Dutt.

In most cases the only reason we vote for them is that they are a familiar surname in a sea of unknown names.  (In the 70s, a large percentage of film industry used to change their surname to Kumar or Kapoor just because they thought that made them have a better chance at becoming a star).

What with Monica Bedi (a known gangster moll), Nagma ( infamous for a hawala transaction of an underworld don), Munna bhai, Shabbuddin, Shibu Soren, Arun Gawli,Raja Bhai, etc all standing for the Lok Sabha and whose only claim to fame was infamy, I did some digging as to how a politician is made in India.

In India it starts with a person playing an active role as a mediator in local issues since the judicial and municipal systems are a complete mess. The person then starts mediating in larger and larger disputes and acquires a local reputation as someone who can get things done. Along comes an election and the local populace naturally approach him to stand since they think he will sort out the mess the country is in too.

Then once elected, the person does not change overnight. He continues to be a mediator. But now its National issues and mediation is not what he has been elected for. He has been elected for Legislating. Something he is completely incapable and ill - suited for.

This time if we really wish to call ourselves an awakened force lets not just vote for a politician because he has a familiar face or surname, lets vote because he knows what he’s doing.

What an Asset

I have been reading in the last few days about the declared assets of politicians politicans assetsand a lot of them are in the Multi crore range.

One thing struck me.

When I looked at my own balance sheet, most of the properties or jewellery I have has been bought a few years ago. So lets say I bought a property in 1990 and paid Rs. 20 Lakhs for it.  To date in my income tax books , it reads as 20 Lakhs.

Here we have politicians declaring land and bungalows worth crores of rupees. This means that the valuation in the Income tax books has to have been done recently, if it is old purchased property it would be in lakhs.

There are only two possibilities, either its old property worth crores a few years ago and worth hundreds of crores today or its newly acquired property.

If its newly acquired isnt it amazing how politicians now can buy crores of property within the last few years that they came to power.

For politicians, India is really shining.
